GENERAL TERMS AND CONDITIONS (T&C)

1. Scope

These General Terms and Conditions apply to all contracts, deliveries, and services provided by Cembalobau Merzdorf (Proprietor: Susanne Merzdorf, hereinafter "Seller") to its customers.

2. Conclusion of Contract

The presentation of instruments on the website or in brochures does not constitute a legally binding offer but rather an invitation to place an order.

For custom-made instruments (new builds), the contract is concluded upon written order confirmation or the signing of a separate construction agreement.

3. Prices and Payment

  • Prices valid at the time of the individual offer apply.

  • Current price lists are non-binding and provided upon request.

  • Invoices are payable within 14 days of the invoice date without deduction, unless otherwise agreed.

4. Retention of Title

The delivered goods remain the property of Cembalobau Merzdorf until full payment of all claims has been made.

5. Delivery, Shipping, and Transfer of Risk

  • Shipping Method: Due to their sensitivity, keyboard instruments are usually delivered by specialized piano movers or personally by us. Shipping and packaging costs are borne by the customer.

  • Transfer of Risk: For shipments, the risk of accidental loss or damage passes to the customer as soon as we have handed over the instrument to the carrier.

  • Inspection: Customers are requested to inspect delivered goods immediately for completeness and transport damage. Visible damage must be reported to the carrier and us immediately.

  • Acceptance: For restorations or new builds, the instrument is deemed accepted once the customer takes possession or does not refuse acceptance within 14 days after notification of completion.

6. Right of Withdrawal (Cancellation)

Note on Custom Orders: According to § 312g (2) No. 1 BGB (German Civil Code) and similar international consumer laws, the right of withdrawal does not apply to contracts for the delivery of goods that are not prefabricated and whose production is determined by an individual choice or specification by the consumer (e.g., harpsichords built to custom specifications).

7. Warranty and Liability

  • Statutory warranty rights apply.

  • Natural Materials: Wood is a living material. Minor variations in color, grain, or climate-related changes (e.g., minimal movement of wood) do not constitute a defect.

  • Climate Responsibility: The customer is responsible for maintaining a suitable indoor climate (recommended: approx. 45-55% relative humidity). The warranty does not cover damage caused by improper storage, lack of care, or unsuitable environmental conditions.

8. Final Provisions

The law of the Federal Republic of Germany applies. Should any provision of these T&C be invalid, the remainder of the contract shall remain in effect.
