General Terms and Conditions (T&C)
Please note: The German version of these Terms and Conditions shall be legally binding. This English translation is provided for information purposes only.
1. Scope of Application
These General Terms and Conditions apply to all contracts, deliveries, and other services provided by Cembalobau Merzdorf, Owner: Susanne Merzdorf (hereinafter referred to as "the Seller"), to its customers.
2. Formation of Contract

The presentation of instruments on the website or in brochures does not constitute a legally binding offer, but rather an invitation to place an order.

For custom-made instruments (new builds), the contract is concluded upon a written order confirmation or the signing of a separate construction contract.
3. Prices and Payment Terms

The prices at the time of the individual offer shall apply.

Customers may request a current price list via the contact form or e-mail. The provision of this price list is non-binding and subject to change.

Invoices are payable in full within 14 days of the invoice date, unless otherwise agreed.

International Sales: For deliveries to non-EU countries, any customs duties, taxes, or import fees are the sole responsibility of the customer.
4. Retention of Title
The delivered goods remain the property of Cembalobau Merzdorf until full payment of all claims has been received.
5. Delivery, Shipping, and Transfer of Risk

Shipping Method: Due to their delicate nature, keyboard instruments are usually delivered by specialized piano movers or personally by us. The costs for packaging and transport shall be borne by the customer, unless expressly agreed otherwise.

Transfer of Risk (Shipping): In the case of shipping, the risk of accidental loss or deterioration passes to the customer as soon as we have handed over the instrument to the freight forwarder or the person designated to carry out the shipment.

Self-Collection: If the instrument is collected from our workshop, the risk passes to the customer upon handover.

Duty of Inspection: The customer is requested to inspect delivered goods immediately for completeness and transport damage. Visible transport damage must be reported immediately to the carrier and communicated to us. The customer's statutory warranty rights remain unaffected.

Acceptance: For major restorations or new builds, the instrument is deemed accepted as soon as the customer takes receipt of it upon completion or fails to refuse acceptance within 14 days of notification of completion, stating specific defects.
6. Right of Withdrawal
Note for custom-made products: In accordance with Section 312g (2) No. 1 BGB (German Civil Code), the right of withdrawal does not apply to contracts for the delivery of goods that are not prefabricated and for whose production an individual selection or determination by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer (e.g., harpsichords built to customer specifications).
7. Warranty and Liability

Statutory warranty rights shall apply.

Natural Materials & Climate: Wood is a living, natural material. Minor variations in color or grain, as well as climate-related changes (e.g., minimal movement of the wood in extreme humidity), do not constitute a defect.

The customer is obliged to ensure an indoor climate suitable for the instrument. Warranty claims do not cover damage caused by improper storage, lack of care, or an unsuitable indoor climate (recommended relative humidity: 45–55%).
8. Final Provisions

The law of the Federal Republic of Germany shall apply. The UN Convention on Contracts for the International Sale of Goods (CISG) is excluded.

Should any provision of these T&Cs be invalid, the remainder of the contract shall remain unaffected.
